Jihadist War Crimes or just Criminals?
With the upcoming trial of Khalid Sheikh Mohammed and the recent shootings at Fort Hood, debate once again rises over the threat of Islamic Extremist. Are these an act of war by the Jihadist against the United States? Or are these just violent criminal acts perpetrated by extremist nut jobs? That is a question that has been brewing since at least 9/11.
The problem with treating them like criminals is that they will then be able to claim the rights of criminals which are many. For an example all you have to do is look at the mess with Abdelbeset Ali Mohmed al Megrahi. The man convicted for orchestrating the bombing of Pam AM flight 103 over Lockerbie Scotland. Due to the rules of Scottish laws, al Megrahi was released and returned home to a heroes welcome.
In the eyes of the Jihadist this was a victory over the West. If we decided to go down the path of criminal law for the Jihadist than there will be moral victories ahead for them.
